Article 1: General Provisions
The e-commerce website doka-deals.be, hereinafter called ‘Doka Deals’, offers its customers the opportunity to purchase products from its webshop online.
These General Terms and Conditions (hereinafter ‘conditions’) apply to every order placed by a visitor (customer) on this e-commerce website. Placing an order via Doka Deals webshop implies that the customer has consulted these conditions and explicitly accepts their applicability, excluding all other conditions. Additional conditions from the customer are excluded unless expressly and in writing accepted beforehand by Doka Deals.
Article 2: Price
All listed prices are expressed in EURO, always including VAT and all other taxes or duties payable by the customer.
If delivery, reservation, or administrative costs are charged, these will be indicated separately.
The price indication refers solely to the items as described in words. The accompanying photos are decorative and may include elements not included in the price.
Article 3: Offer
Although the online catalog and the e-commerce website are compiled with the greatest care, it is possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Doka Deals. Doka Deals is only obliged to make its best effort to ensure the accuracy and completeness of the information offered. Doka Deals is never liable for material errors, typing errors, or printing errors.
If the customer has specific questions about availability, delivery times, or delivery methods of the offered products, we ask the customer to contact our customer service beforehand.
The offer is valid as long as stock lasts and may be adjusted or withdrawn by Doka Deals at any time. Doka Deals cannot be held liable for products being unavailable.
Article 4: Online Purchases
The customer can pay via the following methods:
Online via credit card (Visa or MasterCard)
Online via bank card (BanContact)
Doka Deals cooperates with Shopify Payments for the processing of online payments.
The products offered via this e-commerce website constitute an offer subject to acceptance by Doka Deals.
Doka Deals reserves the right to refuse an order (in writing) due to a serious default by the customer regarding the order or any other order or agreement involving the customer.
Article 5: Delivery and Performance of the Agreement
Items ordered through this webshop are only delivered within Belgium.
Delivery is done by either:
ourselves (personal home delivery)
BPost
DPD
Mondial Relay
Any visible damage and/or quality defect of an item or any other defect upon delivery must be immediately reported by the customer to Doka Deals. The risk of loss or damage transfers to the customer as soon as he (or a third party designated by him who is not the carrier) physically takes possession of the goods.
However, the risk transfers to the customer upon delivery to the carrier if the carrier has been appointed by the customer and this choice was not offered by the customer.
Article 6: Retention of Ownership
The delivered items remain the exclusive property of Doka Deals until full payment has been made by the customer.
The customer commits to inform third parties about the retention of ownership of Doka Deals, e.g., anyone who would seize the not fully paid items.
Article 7: Right of Withdrawal
The provisions of this article only apply to customers who purchase items online from Doka Deals as consumers.
The customer has the right to withdraw from the sales agreement and/or delivered items without paying a penalty or giving a reason. The customer must inform Doka Deals within 14 calendar days after delivery of the products. The transport costs for returning these items are at the expense of the buyer. The buyer has 14 days to return the products after notifying the return.
Once the products are back in possession of Doka Deals, they will be reimbursed via the payment method used for the order, unless otherwise agreed between the customer and Doka Deals.
Article 8: Warranty
Pursuant to the law of 21 September 2004 concerning the protection of consumers in the sale of consumer goods, the consumer has legal rights. This statutory warranty applies from the date of purchase (or delivery) by the first owner. Any commercial warranty does not affect these rights.
To claim warranty, the customer must provide proof of purchase. Customers are advised to keep the original packaging.
For items purchased online and delivered to the customer's home, the customer must first contact customer service and then return the item at their own expense to Doka Deals.
If a defect is found, the customer must notify as soon as possible.
In any case, any defect must be reported within 2 months after discovery by the customer. After that period, any right to repair or replacement expires.
The (commercial and/or statutory) warranty does not apply to defects caused by accidents, neglect, falls, use contrary to the intended purpose, failure to follow instructions or manuals, modifications or alterations, rough use, poor maintenance, or any other abnormal or incorrect use.
It also does not apply to items with a short lifespan or wear parts. Defects appearing after 6 months from the purchase (or delivery) date are assumed not to be hidden defects unless proven otherwise by the customer.
The warranty is non-transferable.

Article 10: Sanctions for Non-Payment
Without prejudice to other rights available to Doka Deals, in case of non-payment or late payment from the date of default, the customer owes by operation of law and without notice an interest of 10% per year on the unpaid amount. Furthermore, the customer owes a lump-sum compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice, by operation of law and without notice.
Without prejudice to the foregoing, Doka Deals reserves the right to take back the not (fully) paid articles.
Article 11: Invalidity – Non-Waiver
If any provision of these conditions is declared invalid, unlawful, or void, this shall in no way affect the validity, legality, and applicability of the other provisions.
Failure by Doka Deals at any time to enforce any right listed in these conditions, or to exercise any right, shall never be considered a waiver of such provision and will never affect the validity of these rights.
Article 12: Amendments to Conditions
These conditions are supplemented by other conditions explicitly referred to and Doka Deals’ general sales conditions. In case of conflict, these conditions take precedence.
Doka Deals may change these conditions at any time without further notice. Any purchase after the change implies acceptance by the customer of these new conditions.
Article 15: Evidence
The customer accepts that electronic communications and backups may serve as evidence.
Article 16: Applicable Law – Competent Court
Belgian law applies, except for provisions of private international law regarding applicable law.
The courts of the consumer’s place of residence have jurisdiction in legal disputes. The consumer may also use the ODR platform (http://ec.europa.eu/consumers/odr/).
